Huntington, WV - A client represented by Attorney David Perry collected slightly more than $14,000 in diminished value (DV) when his vehicle, a relatively new Mercedes-Benz, was damaged by a dumpster. Actual damage to the auto totaled about $4,000.

Lexington, KY - A client represented by Attorney Robert Losey received a check from the responsible insurer for the full value of her Honda Accord when it was eventually totaled. The insurer had previously tried to get by repairing the car for a cost of about one-third of the vehicle's retail value.
Ashland, KY - A Kentucky dealership denied a large warranty claim on a relatively new car when its owner tried to get some malfunctioning parts replaced. Our inspection confirmed the dealer's suspicion that the car had been wrecked and repaired. The failed parts were the result of an undisclosed accident, not faulty parts the manufacturer installed.
Cincinnati, OH - A couple collected better than $6,000 in DV when their relatively new BMW Z3 was rear-ended by another driver. The BMW had sustained slightly more than $8,000 in damage and was repaired fairly well. This case was settled in arbitration.
Findlay, OH - A truck belonging to Findlay business owner, Rick Riggs suffered a crash early in 2007. State Farm, the responsible insurer, suggested Riggs use one of its preferred body shops and ok'd an initial estimate to correct about $16k in damages using structural parts it located in area junkyards. Ultimately, expenses grew to more than $21k. Still, the truck remained unsafe to drive, darting and handling erratically despite five subsequent repair attempts over the next year. Attorney Michael J. Malone represented Riggs in the matter using documents from an inspection provided by Safe Collision Repairs' founder David Williams. State Farm settled with Riggs and bought his vehicle to remove it from service paying him an additional $36,000 to take possession.
Peterstown, WV - An insurer saw fit to total a vehicle and pay the retail value to the owner after the company had previously paid nearly $7,000 to have repairs performed on the claimants car. The reason for the buyback: the method and quality of the repairs was found to be insufficient to indemnify the owner. In this case, the insurer had hired an adjusting company to assess the damage and prepare an estimate that the repair shop would follow.
In an effort to look good to the insurer and save it money, the adjusting company recommended clipping the car, even though it knew the auto repair was not approved by the vehicle's manufacturer. Although most insurers consider our work adversarial, we were hired by the insurer in this particular case, to evaluate the methods and repairs recommended by the appraisal company it hired. The insurer followed our recommendation in totaling the car.
